In a recent case, federal prosecutors have failed to persuade the Ontario Court that the presence of toy guns in a vehicle may be cause for a search police. It sounds a little weird, but has very serious reasons. The entire case revolves around John Aselford, in July 2003 was arrested by police in Bells corners near Ottawa, traveling from a party with friends. His car was searched. The police argued that the search that discovered several power spring toy guns Airsoft in and searched his truck for "security" reasons. As a result of the search for weapons of truth is not found, but police found 300 grams of marijuana. At trial, Const. Pender Shelley submitted that in the time it took the guns forward to inspect a bag of drugs fell. In 2007 Aselford was acquitted of drug charges because the judge did not believe the official version. All this sounds like the officers were trying to cover his security search with other questionable actions.

There is an undeniable fact that some years ago a decision of the Supreme Court confirmed that the police can search the car and its occupants for weapons if public safety is at risk. In the case of John Aselfor, officers were responding to a report of a shooting in the area, but could stop the search once they discovered that the weapons were in the back seat actually toys.

The police in this case are not leading a witch hunt for weapons, recent cases show that the situation is getting very nice. In addition to regular shootouts between organizations criminals and gangs that we can take some recent situations that are actually a bit weird.

Shootings on the Toronto Transit Commission vehicles or platforms are becoming more regular. If we take 2008 there was a shootout important in March when a group of youths opened fire inside a subway car full of people from St. George and Spadina subway stations. Fortunately no one was killed, only one woman was injured. In December 2008, the bus driving along TTC Eglinton Avenue West, near Dufferin Street was hit by two bullets fired by someone on the street, this time also was hurt anyone. In January 2009 we have a great shot in the TTC subway. There shooting incidents within 3 from 2000 to 2005, if we take 2008 and 2009, we have three cases. It's really a very small number and no fatalities, but everyone understands that a shooting at a crowded bus can lead to very serious casualties and literally turn the bus into a death chamber.

Few of Last week also saw a shooting in two suburbs of Edmonton. Residents were only surprised by the violence. Two homicides in the neighborhoods in just two hours, one of them almost Hollywood style with a car that crashed into a house. The neighborhoods were very calm before the incidents.

So maybe a search firearms is not so bad after all.
